Immigration NewsRegional Center Program Reauthorization
The EB-5 Regional Center Program authorization is now extended to December 8, 2017 thanks to H.R.601, which the President signed into law on September 8, 2017. All government functions are continued until Dec. 8 under this law, including immigration measures for EB-5, E-Verify, Conrad 30, and Religious Workers.
Government Agrees to Inform Travelers Denied Entry to U.S. of Right to Reapply for Visas.
In Darweesh (Iraqi national) v. Trump, No. 17-CV-480 (CBA), that followed President Trump Travel Ban, a Federal Judge in New York issued an injunction blocking the travel ban. Although Iraq was dropped from the list of banned countries, the parties have still decided to settle. Under the settlement, the parties agreed to the following:
- The Administration will email in English, Arabic, or Farsi any individuals from the seven countries included in the January 27 travel ban who were barred from entry to the U.S. before the travel ban was enjoined (and who have not returned to the U.S.)
- The email will advise them of their right to reapply for a new visa and include a list of free legal service providers who will assist them with their renewed applications
- The Department of Justice must coordinate the processing of the renewed applications
Rescission of Deferred Action For Childhood Arrivals (DACA)
On Sept. 5, 2017, the Department of Homeland Security (DHS) initiated the orderly phase-out of the program known as Deferred Action for Childhood Arrivals (DACA). DHS will provide a limited, six-month window during which it will consider certain requests for DACA and applications for work authorization, under specific parameters. Read the memorandum from Acting DHS Secretary Elaine Duke for details. DACA is a mode of temporary relief given to children (now college-aged or older) who entered the United States without inspection with their parents and allowed them to apply for temporary work authorization if they meet certain criteria.
USCIS Resumes Premium Processing for Some Categories of Applicants Seeking H-1B Visas.
On Septemeber 18, 2017, U.S. Citizenship and Immigration Services (USCIS) resumed premium processing today for all H-1B visa petitions subject to the Fiscal Year (FY) 2018 cap. The FY 2018 cap has been set at 65,000 visas. Premium processing has also resumed for the annual 20,000 additional petitions that are set aside to hire workers with a U.S. master’s degree or higher educational degree.
Coming Soon: New Trusted Traveler Programs Website
U.S. Customs and Border Protection announced plans today to launch a new Trusted Traveler Programs website in October. CBP will transition from the Global Online Enrollment System to the Trusted Traveler Programs System which will facilitate the enrollment and membership of the Global Entry, NEXUS, SENTRI and FAST programs.
